These Terms form an agreement between you and Peakwalk Info Tech Ltd. concerning the Well Control website at https://well-control.eaxmarketplace.com. By accessing or using the website, you agree to these Terms and acknowledge the Educational Disclaimer and Privacy Policy. If you do not agree, do not use the website.
2. Website access
Peakwalk permits you to access and use the website for lawful personal education, evaluation of the Well Control App and internal professional development. This permission is limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable. These website Terms do not replace the separate terms presented within the mobile application.
3. Acceptable use
You must not:
- copy, sell, license, distribute or commercially exploit the website or a substantial part of its content without written permission, except where permitted by law;
- scrape, systematically extract or reproduce content, bypass security controls, introduce malicious code, overload the website or attempt unauthorised access;
- use the website or its content to conduct live well operations, replace approved procedures or claim professional certification or competence;
- submit unlawful, harmful, infringing, confidential, export-controlled or malicious material; or
- remove copyright, trade mark, disclaimer or proprietary notices.
4. Educational content
The Educational Disclaimer forms part of these Terms. Website descriptions, examples, previews and other content are general educational information and marketing information about the App. They are not engineering, operational or safety advice, approved well-control instructions, accredited training, certification or evidence of competence.
5. Intellectual property
The website, App branding, interface previews, text, graphics, logos and other content are owned by or licensed to Peakwalk and protected by intellectual-property law. Third-party names and marks belong to their owners. Reference to IWCF, IADC, Apple, Google or another organisation does not imply endorsement, approval, sponsorship or affiliation.
6. Feedback and content reports
If you submit a correction, suggestion or feedback, you grant Peakwalk permission to use and adapt it to improve the website or App without compensation. You confirm that you may submit it and that it contains no unauthorised confidential or personal information.
7. External links and services
The website may link to app stores, email services, Google services or other third-party websites. We do not control third-party services or guarantee their availability, security, content or accuracy. Your use of them is subject to their own terms and privacy notices.
8. Website availability and changes
We may correct, add, change, suspend or remove website content or functionality at any time. We do not guarantee that the website will always be available, uninterrupted, secure or free from errors. App features shown on the website may change before or after release and may not be available on every platform, device or location.
9. Warranties and liability
To the maximum extent permitted by law, the website and its content are provided “as is” and “as available”. We do not guarantee accuracy, completeness, currency, uninterrupted access, examination success or any professional or operational outcome. Mandatory consumer rights remain unaffected.

Subject to that limitation, Peakwalk and its officers, employees, contractors, contributors and licensors are not liable for indirect or consequential loss, lost profit, revenue, opportunity, data or business, operational delay, non-productive time, equipment or well damage, pollution or loss arising from reliance on educational content.
Where liability cannot be excluded, Peakwalk’s total liability relating to use of the free website will not exceed USD 50, except where mandatory law requires a different remedy or amount.

The Privacy Policy explains how the website processes technical data, support communications and Google Analytics information. Where consent is required for non-essential analytics or similar technologies, the applicable consent choice will govern their use.
